First, we break down the Supreme Court’s 8-1 decision in Chiles v. Salazar, a case involving Colorado’s law regulating certain counseling conversations with minors. The Court held that, as applied to licensed counselors’ talk therapy, the law may amount to viewpoint-based speech regulation and must face strict scrutiny under the First Amendment. The ruling draws a sharp distinction between regulating professional conduct and regulating protected speech.
We also examine the Court’s latest birthright citizenship arguments, where the justices questioned the legality of President Trump’s January 2025 executive order seeking to deny automatic citizenship to some children born in the United States unless a parent is a U.S. citizen or lawful permanent resident. During oral argument, the Court raised concerns about the text and history of the 14th Amendment, the scope of executive power, the role of nationwide injunctions, and the practical consequences of changing a longstanding understanding of citizenship.
